Simsoft IT Ltd Terms of Use The sites, www.simsoft.com are owned and operated by Simsoft IT Limited (‘Simsoft’ hereinafter,), Suite 14, 176 Finchley Road, London, NW3 6BT, United Kingdom, a registered company in England and Wales, Company Number 04372902. Access to, and use of, this site is provided by Simsoft IT Ltd, and is subject to the following Terms of Use; 1. Your use of this site constitutes your acceptance of these terms and conditions. The Simsoft does not warrant that the functions embedded within the material contained in this site will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the materials. 11. Client-Only Sections Access to the Client-only sections of this site is at the discretion of Simsoft and will normally only be provided to Simsoft clients. Clients who satisfy the access criteria will be provided with an individual Cleint username and password. All Clients undertake to safeguard their username and password details and agree not to disclose or share them with anyone. The Client-only section of the Website is one of a number of exclusive benefits provided to Simsoft Clients and use of the Client-only sections is additionally subject to Client acknowledgment that the materials to which they have access are confidential in their nature and Client agreement, that the materials may only be viewed or downloaded by Clients for their sole and exclusive use in connection with the legitimate business purposes of the Simsoft Client Company. In order to ensure the integrity of our security systems any Client representative found to be in breach of these obligations will have their access rights withdrawn. Any Client experiencing difficulties accessing the Client sections should report the problem to webmater@simsoft.com 12. Personal Data In order to gain access to certain pages of this site or in order to receive certain Simsoft services you will be asked to submit personal information about yourself (for example, name and e-mail address). Simsoft will treat all such information in accordance with the Data Protection Act 1998 and Simsoft’s Privacy Policy detailed below. 13. These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales and shall be subject to the exclusive jurisdiction of the courts of England and Wales. 14. Should any of these Terms of Use be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms of Use are intended to be effective, then to the extent and within the jurisdiction which that Term of Use is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining terms of use shall survive, remain in full force and effect and continue to be binding and enforceable.
